Some Ethical Reflections on the EU AI Act

Résumé

This article considers the European Commission AI Act proposal development process and the aims and conceptual vision explicitly and implicitly embedded in the Act, specifically from the point of view of ethics as a practice. I argue that the often-encountered tendency by many authors to invoke ethics and law together 'in the same breath,' needs to be reexamined , both with regard to ethics of AI, and here, in a more concrete context, with regard to the AI Act proposal. On the basis of sustained reflection on the Act in light of ethics, there are a number of reasons to reject the claim of the AI Act regulation as being ethically grounded. Among these reasons are: the proposal's characterization of the objectives of the AI Act, the proposal's vision and use of public and even democratic consultation, and finally, the arbitrary embedding of what I shall call the 'speed paradigm' in both the regulatory process and the view of AI as a technology.
